Membership Terms and Conditions
Safety First
Your safety is our priority. This section outlines your responsibilities in helping us maintain a secure and supportive environment for all members.
Using Equipment Safely
Before using any equipment or facilities, you must complete a mandatory OHS induction—either via our instructional video or in person with a staff member. You agree to use all equipment responsibly and as intended. If you're ever unsure about how to operate a piece of equipment, please ask a staff member before using it.
Your Physical Condition
To design a safe and effective exercise program, it is essential that you provide accurate and up-to-date health and fitness information—either through our pre-exercise questionnaire or other means.
You confirm that the information you provide is true, complete, and not misleading. You must not use the facilities if you are experiencing any illness, injury, or condition that may pose a risk to yourself, other members, or staff.
If you use the facilities before providing your health profile, you declare that you are in good physical condition and have no reason to believe it would be unsafe for you to exercise.
Gym Etiquette and Conduct
Our Gym Etiquette Standards
To ensure a welcoming and respectful environment for all, we maintain gym etiquette guidelines displayed throughout the facility and on our website. These standards promote safety, respect, and care for equipment and facilities. Please read them carefully and speak with a staff member if anything is unclear.
We may update these guidelines from time to time to improve safety or operations. We encourage members to stay informed by regularly reviewing signage and our online platforms.
Breaches of Gym Etiquette
If you breach our etiquette standards, we will respond appropriately. For minor issues, a warning may be issued. However, for serious or repeated breaches, your membership may be suspended or cancelled immediately. The health, safety, and enjoyment of our members and staff are of utmost importance.
Right to Refuse Entry
We reserve the right to deny access or terminate your membership without notice if you:
• Engage in threatening, abusive, or harassing behaviour
• Use equipment dangerously or inappropriately
• Deliberately damage facilities or equipment
• Use or distribute illegal or performance-enhancing substances
Following Directions
You agree to follow all reasonable instructions from staff, including any safety announcements or emergency procedures (e.g. fire evacuation).
Privacy and Monitoring
Your Privacy
When you apply for membership, we collect personal information (e.g. health and financial details). This information is managed in line with our Privacy Policy, available on our website.
Video Surveillance
We use video monitoring throughout the premises to ensure the safety and security of all members and staff. If you have questions, please contact us.
Keeping Your Contact Details Up to Date
Please notify us promptly of any changes to your personal information, including your address, email, phone number, or payment details. This ensures we can contact you when necessary and maintain accurate records for your health and safety.
Your Membership
Membership Inclusions
Your membership entitles you to access the facilities and services outlined under your selected membership type, starting from your agreed Start Date.
Cooling-Off Period
You may cancel your membership within 48 hours of joining by providing written notice. A $50 administration fee will apply, along with charges for any services already used. All refunds will be issued via direct deposit within 7 days (no cash refunds).
Membership Cancellation
Following the cooling-off period, you may cancel your membership by giving 28 days’ written notice to: info@savutihealthandfitness.com.au
Please provide a brief reason for cancellation. We may reach out to discuss possible alternatives such as suspension options or support to help you stay active.
If you’re relocating beyond reasonable travel distance (interstate or overseas), your membership will end after the 28-day notice period. You must continue paying during the notice period, even if you stop attending.
Unpaid accounts that require debt collection or legal services will incur additional recovery costs, including solicitor fees. Memberships are non-transferable.
Prepaid Memberships (Upfront)
All prepaid (upfront) memberships, personal training packages, and access fobs are non-refundable, including any unused portion.
Membership Suspension (Hold)
You may request to temporarily suspend your membership for travel (7+ days) or medical reasons if:
• Your account is in good standing
• You have at least two weeks remaining on your membership
• You provide written notice at least 7 days before the suspension
• You submit supporting documentation (e.g. travel itinerary or medical certificate)
Membership suspension is limited to two occasions per year, with a maximum of three months total. During suspension, your membership term is extended, and direct debit payments are paused.
Special provisions apply for military deployment, extended jury duty, or long-term illness.
Membership Type Changes
If you're on a family/partner membership (e.g. Pride Membership) and the other member cancels, you must either:
• Pay the current rate for an individual membership, or
• Find a replacement within 14 days
Minimum Age
Members must be at least 14 years old. Anyone under 18 must have a parent or guardian co-sign their agreement and indemnity waiver.
Members aged 14–16:
• May attend only during staffed hours
• Will not receive access fobs
• Must have a parent or guardian complete an induction form
Gymmaster Portal and Communication
You must provide a valid personal email address to access the Gymmaster portal. We may occasionally contact you via email with updates or promotions. You can opt out at any time.
Liability and Responsibilities
Statutory Guarantees
Under the Australian Consumer Law (ACL), our services are subject to certain guarantees (e.g. due care, fitness for purpose, timely delivery). However, where permitted under section 139A of the ACL, we exclude liability for:
• Death or injury resulting from non-reckless conduct
• Injury, illness, or harm arising from use of the facilities
• Transmission of infectious diseases (e.g. COVID-19)
This exclusion does not apply where injury is caused by our reckless conduct.
Loss or Damage to Property
We encourage you not to bring valuables into the club. If lockers are provided, we recommend using them. We are not responsible for theft or loss, except where required by law.
Damage to Club Property
You agree to cover any damage to club property caused by you or your guests due to negligence or deliberate action.
Payments and Direct Debit
Payment Obligations
By providing your bank or card details, you authorise us to debit all applicable fees. It is your responsibility to ensure sufficient funds are available on each payment day.
Late or Failed Payments
If a payment fails, associated bank or processing fees may be charged to you. We may continue attempting to collect the outstanding amount. If multiple payments are missed, we will attempt to contact you.
Direct Debit Provider
We use Ezidebit Pty Ltd for payment processing. Ezidebit acts only as a third-party collection agent and is not responsible for any products or services provided by Savuti Health and Fitness.
Direct Debit Service Agreement

Ezidebit will appear on your statements as the merchant. All membership-related queries or disputes must be directed to Savuti Health and Fitness.
General Terms
Unforeseen Circumstances
We are not liable if circumstances beyond our control prevent access to the facilities (e.g. natural disaster, pandemic, or government mandate). If such a disruption continues for over 30 days, either party may cancel the agreement.
We may close the facility for up to two weeks per year for maintenance or upgrades, in which case your membership will be extended accordingly.
Intellectual Property
All content, branding, programs, and materials remain the intellectual property of Savuti Health and Fitness and may not be reproduced or used for other purposes.
Transferring Membership Rights
We may assign or subcontract our rights or responsibilities under this agreement at any time, provided your membership benefits remain unchanged.
Severability
If any clause in this agreement is deemed invalid or unenforceable, the remainder of the agreement will continue in full force.
Applicable Law
This agreement is governed by the laws of the State or Territory in which the club is located.
